Extension for Annual Fire Safety Statement (AFSS)

The Environmental Planning and Assessment (Development Certification and Fire Safety) Regulation 2021 (the Regulation) requires Annual Fire Safety Statements (AFSS) to be submitted to Council, certifying all of the essential fire safety measures installed in the building/premises. The NSW Government introduced reforms through the Regulation to strengthen fire safety certification for new and existing buildings.

Fire safety reform information have been developed to assist owners and practitioners with the requirements.

Where an annual fire safety statement cannot be submitted due to legitimate unanticipated circumstances, Council in limited circumstances will consider an application to extend the due date for the statement submission for a short period of time. This will only be considered where it can be demonstrated that active fire systems remain in place to a satisfactory level for occupation to be maintained. Fees apply in accordance with Council’s fees and charges schedule.

Ensuring that systems are properly maintained and functioning to the required standards, as well as conducting necessary testing and issuing an AFSS on time, is the legal responsibility of the building and property owners. Regardless of any time extensions, property owners remain responsible for their buildings and the proper functioning of fire safety systems.
