Disclosure of political donations and electoral expenditure
Candidates and groups of candidates who participated in the recent September 2024 local government elections as well as elected councillors and mayors must comply with the provisions of the Electoral Funding Act 2018, including disclosing information about political donations and electoral expenditure to the NSW Electoral Commission. The next disclosure lodgement period commences on 1 January 2025 and, noting that first time candidates and some councillors may not be familiar with these disclosure reporting requirements, we are contacting you at this time with information about the upcoming disclosures due, to share with your councillors.
Who is responsible for submitting disclosures to the NSW Electoral Commission?
Candidates and councillors (including mayors) are responsible for lodging their own disclosures of political donations and electoral expenditure to the Electoral Commission (unless they are a member of a registered political party and there is an agreement with the party agent of the party for the party agent to be the person responsible for making disclosures on the candidate or councillor’s behalf. The Electoral Commission must be advised of this agreement, using the approved form).
Councillors and mayors have multiple disclosures due
Councillors/mayors who were also candidates in the half-year period, must submit two disclosure forms: an “elected member” disclosure and a “candidate” disclosure. If they were also the lead candidate of a group of candidates at the election, they must submit three disclosures: an “elected member” disclosure, a “candidate” disclosure, and a “group” disclosure.
If no political donations were made or received (and/or electoral expenditure incurred), a “Nil” disclosure must be lodged with the Electoral Commission, for the relevant period.
When are disclosures due?
The next half-yearly disclosure of political donations, for the reporting period 1 July 2024 to 31 December 2024, must be lodged with the Electoral Commission between 1 January 2025 and 11 February 2025. The following disclosures must be lodged for the 2024/2025 year:
